AppInChina provides a range of Services designed to assist clients in distributing software, apps, and websites in China. These services include:
- App Distribution: Uploading and updating client apps on major Chinese app stores.
- Compliance Support: Helping clients obtain necessary licenses and ensuring content meets regulatory requirements.
- In-App Payment Solutions: Integrating payment platforms (e.g., WeChat Pay, Alipay) and facilitating fund transfers.
- Cloud Accounts Provisioning: Creating and managing cloud accounts for clients with full access and administrative capabilities.
These Terms apply to all interactions and transactions involving the Services. This document provides a general definition of the services we offer. When signing a contract with AppInChina, each client will receive a specific agreement outlining the services and conditions applicable to their engagement.
2. Client Responsibilities
To ensure successful delivery of Services, clients are expected to:
- Provide Accurate Information: Supply all necessary and accurate information required for app distribution, compliance, and payment integration.
- Comply with Laws and Regulations: Ensure that their content, data, and activities align with applicable laws and regulations, including but not limited to those in China.
- Maintain Security: Protect access credentials for shared tools, including the AppInChina Dashboard, and immediately notify us of any suspected security breaches.
- Timely Communication: Respond promptly to requests for additional information or approvals to avoid delays.
3. Fees and Payments
- Service Fees: Fees for the Services are outlined in individual service agreements and invoices. Payment terms will be specified in these agreements.
- Payment Methods: Payments must be made using the methods specified in the invoice or agreement.
- Late Payments: Late payments may incur penalties or interest as specified in the service agreement.
4. Data Privacy and Security
- Client Data: AppInChina collects and processes client data in accordance with our Privacy Policy. Clients retain ownership of their data, and we commit to safeguarding it using appropriate technical and organizational measures.
- Confidentiality: Both parties agree to keep sensitive information confidential, including business data, trade secrets, and proprietary information shared during the course of engagement.
- Compliance with Privacy Laws: We follow general privacy standards to ensure data is handled responsibly and securely.
5. Service Availability and Limitations
- Availability: While we strive to ensure uninterrupted Services, there may be occasional downtime due to maintenance or unforeseen technical issues.
- Third-Party Dependencies: Some Services rely on third-party platforms (e.g., app stores, payment processors). AppInChina is not responsible for disruptions or delays caused by these third parties.
- Service Adjustments: We reserve the right to modify, suspend, or discontinue any part of the Services with prior notice where feasible.

- Client Content: Clients retain ownership of their content submitted for distribution or compliance purposes. By using the Services, clients grant AppInChina a limited license to use, store, and process this content solely for service delivery.
7. Termination
- By Client: Clients may terminate their use of the Services with written notice, subject to any applicable termination clauses in their service agreement.
- By AppInChina: We may suspend or terminate Services if a client breaches these Terms or fails to fulfill payment obligations.
- Post-Termination Obligations: Upon termination, clients are responsible for settling any outstanding payments. AppInChina will return or delete client data upon request, as outlined in our Privacy Policy.
8. Limitation of Liability
To the maximum extent permitted by law, AppInChina is not liable for indirect, incidental, or consequential damages arising from the use of our Services. Our total liability is limited to the fees paid for the specific Service related to the claim.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of the People's Republic of China. Any disputes shall first be resolved through good-faith negotiations. If unresolved, disputes will be referred to arbitration as specified in the service agreement.
